1.Scope of the general conditions of sale and definitions


These general conditions of sale (hereinafter the "GTC") apply to the website of the Atelier YUKAKO online store, accessible at the address https://www.atelieryukako.com (hereinafter the “Website”) via the website https://www.atelieryukako.comas well as orders placed on the Website.
In these T&Cs, references such as "we" / "our" refer to Atelier YUKAKO (located at 21, rue Sergent Blandan 69001 Lyon) and all references such as "you" / "your" refer to the customer as as a user of the Website.

Please read the T&Cs carefully before placing your order on the Website. Access to certain parts of the Website, as well as orders placed on the Website, are subject to the application of these T&Cs. We advise you to make a copy of these T&Cs so that you can refer to them later.

2.The sales contract


Your order constitutes acceptance of our offer and in particular acceptance of the price offered and the products designated. Consequently, when you confirm your order, you agree to be bound by the sales contract.

We are committed to honoring the orders we receive within the limits of available stocks. If the product you ordered is not available, we will notify you and we will cancel the order for the product which is no longer available. In the event that only some of the products are available, we will inform you by e-mail of the unavailability of the other products. The order relating to products that are no longer available will be refunded if necessary.

The photographs and texts illustrating the products do not enter into the contractual field. If these photographs and/or texts were incorrect, Atelier YUKAKO cannot be held liable for this.

Acceptance of the order is subject to validation of your payment.

If the payment should not be validated by the issuer of the credit card or if it should prove to be fraudulent or in the case of reasonable suspicion of fraud, your order will not be accepted and will be automatically cancelled.

If you do not have to comply with the provisions of these GCS and in particular, the provisions of article 7 which requires that the goods delivered be returned in their original condition, or if you have not made payment to Atelier YUKAKO for any of your orders, Atelier YUKAKO reserves the right to refuse your future orders.

Online purchases are for your personal use or intended to be gifted and are not, under any circumstances, intended to be used for resale, for commercial purposes or for any other purpose. We reserve the right to refuse orders when large quantities of the same item are ordered by one and the same consumer or to one and the same address.

3. Order

When you have placed an order, you will automatically receive an email confirming your order (“Confirmation Email”) recalling the details. We recommend that you print this email and keep it. This confirms that we have received your order.
When your items are shipped, a second e-mail will be sent to you ("Delivery e-mail") which will indicate the shipping number of your package in order to follow its journey via the La Poste website (http://www.laposte.fr).

Custom made items are not exchangeable or refundable.

4. Price and payment methods

Prices are shown in Euros exclusive of VAT (under § 19 of the Small Business Act we do not display or charge VAT), and exclusive of delivery costs. These remain the responsibility of the customer, except under special conditions.

Atelier YUKAKO reserves the right to modify its prices at any time. The products will be invoiced on the basis of the rates in force at the time of the registration of the order.
In case of payment by check, the order will be sent once the check has been cashed.

5. Payment security


To ensure security, Atelier YUKAKO uses Paypal's secure payment service. Bank data is encrypted and therefore does not circulate in the clear on the network.

6. Late/non-delivery


Colissimo Suivi and letter tracking are very reliable services. However, it is possible, as in any expedition, that there may be a delay in delivery or that the product may get lost. In the event of late delivery (from the day the order is dispatched, more than 11 days for Colissimo and follow-up letter), the buyer must inform Atelier YUKAKO's Internet customer service. This information can be provided by e-mail to the following address: [email protected]. Atelier YUKAKO will send the information to La Poste to trigger the opening of an investigation. This investigation can last up to 21 days from the opening of the file. If during this period, the product is found, it will be re-routed immediately to the Buyer's home (in the majority of cases). If, on the other hand, the product is not found at the end of the period of 21 days of investigation, the Post office considers the parcel as lost. In this case, Atelier YUKAKO will send you, at its expense, a replacement product. If the lost product(s) were no longer available at that time, Atelier YUKAKO would refund the amount of these products to you or, if we have the fabric in stock, ATELIER YUKAKO would remake these products. Atelier YUKAKO declines all responsibility for the extension of delivery times due to the carrier, particularly in the event of loss of products or strikes. Atelier YUKAKO cannot be held liable for any inconvenience or damage inherent in the use of the Internet network, in particular a break in service, an external intrusion or the presence of computer viruses, or a fact qualified as force majeure, in accordance to case law.
Furthermore, Atelier YUKAKO disclaims liability for any breach of its contractual obligations in the event of force majeure or fortuitous events, including, without this list being exhaustive, strikes, fires, disasters, breakdowns and in general any event that does not allow the proper execution of the orders.

10. Entirety


In the event that one of the clauses of this contract would be null and void by a change in legislation, regulation or by a court decision, this cannot affect the validity and respect of these general conditions of sale.

11. Duration


These conditions apply for the entire duration of the online services offered by Atelier YUKAKO.

12. Applicable law and disputes


These general conditions of sale are subject to French law. In the event of a dispute, the parties undertake, before any legal action, to seek an amicable solution. Only the French courts will be competent. The competent court in the event of a dispute will be that of the place of residence of the defendant or, at the choice of the defendant, of the place of actual delivery of the product.
